These Terms of Service ("Terms") govern your access to and use of ai.Stacker Pro, an AI-powered research and analytics platform operated by Greek-Fire Corporation ("Company," "we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. In such cases, "you" and "your" refer to both you individually and the organization you represent.

ai.Stacker Pro provides an AI-powered research platform that enables users to conduct advanced data analysis, leverage machine learning models, and generate research insights. The Service includes, but is not limited to, AI model access, data processing tools, collaborative workspaces, API integrations, and analytics dashboards.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration & Security

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate, current, and complete.

5. Intellectual Property Rights

The Service and its entire contents, features, functionality, and underlying technology (including but not limited to AI models, algorithms, software, text, graphics, logos, and trademarks) are owned by Greek-Fire Corporation, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

These Terms do not grant you any right, title, or interest in the Service or any content therein, except for the limited license to use the Service in accordance with these Terms. All rights not expressly granted herein are reserved by the Company.

6. User Content & Research Data

You retain ownership of all data, content, and materials that you upload, submit, or generate through the Service ("User Content"). By submitting User Content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, process, store, and display your User Content solely to the extent necessary to provide and improve the Service.

You represent and warrant that you have all necessary rights and permissions to submit your User Content and that your User Content does not infringe upon the intellectual property rights or other rights of any third party.

We do not claim ownership of your research outputs. However, we may use anonymized and aggregated usage data to improve our AI models, enhance the Service, and conduct internal research, provided such data cannot be used to identify you or any individual.

7. Subscription & Payment Terms

Certain features of the Service require a paid subscription. Subscription plans, pricing, and included features are described on our pricing page and may be updated from time to time. All fees are stated in United States dollars unless otherwise specified.

Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on the plan selected). By subscribing, you authorize us to charge the applicable fees to your designated payment method on each billing cycle.

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period, and you will continue to have access to paid features until that time. We do not provide prorated refunds for partial billing periods unless required by applicable law.

We reserve the right to change subscription fees upon reasonable notice. If you do not agree to a fee change, you may cancel your subscription before the new fees take effect.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GREEK-FIRE CORPORATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE AI MODELS AND RESEARCH OUTPUTS GENERATED THROUGH THE SERVICE WILL BE ACCURATE, RELIABLE, OR COMPLETE. YOU ACKNOWLEDGE THAT AI-GENERATED CONTENT MAY CONTAIN ERRORS AND SHOULD BE INDEPENDENTLY VERIFIED BEFORE RELIANCE.

10. Indemnification

You agree to indemnify, defend, and hold harmless Greek-Fire Corporation, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) your User Content. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, we will delete or anonymize your personal information in accordance with our Privacy Policy, except as required to comply with legal obligations, resolve disputes, or enforce our agreements. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms and any dispute arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within the State of Delaware for the resolution of any disputes arising under these Terms.

13. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service, you agree to first attempt to resolve the dispute informally by contacting us. We will endeavor to resolve the dispute through good-faith negotiation within thirty (30) days of receiving your notice.

If the dispute cannot be resolved through informal negotiation, either party may initiate binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall be conducted in the State of Delaware by a single arbitrator, and the arbitrator's decision shall be final and binding.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against Greek-Fire Corporation.

14. Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page and provide notice through the Service or via email to the address associated with your account.

Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue your use of the Service and close your account.
